Terms and Conditions

1. About the Website

1.1. Welcome to www.stockbinge.com.au (the ‘website’). StockBinge is the owner of this website. The website allows users access to and usage of the website. Kindly carefully read these terms and conditions. By viewing the website, you acknowledge that you have read, understood, and accepted the Terms. If you disagree with the terms, stop using the website and services.

1.2. Warning: This website, together with its newsletters and reports, offers general financial information without considering the needs or investment goals of any one person. Before following any recommendations, consult your financial planner, stock broker, or counselor.

1.3. StockBinge, at its sole discretion, has the right to review and amend any of the Terms by amending this page. When necessary, the Terms and Conditions will be updated on the website. Any alterations to the terms become effective after posting. We suggest that you print off a copy of the terms for your records before moving on.

2. Accepting Terms

Remaining on the website indicates that you have read and agreed to the conditions. When you are presented with the option to accept the Terms by StockBinge in the user interface, you have the choice to accept the Terms by clicking on the button that says "accept or agree to the Terms."

3. Subscription to Services

3.1. To access the services, you first have to buy a subscription through the website, email, or phone and pay the applicable amount for the selected subscription.

3.2. When you buy the subscription, you agree and understand that it is your duty to make sure that the subscription you choose is right for your needs.

3.3. When you register for the services or continue to use them, you may be asked to provide sensitive information about yourself, like your name, address, and phone number. This information may include: (a) Email address (b) Please provide your preferred username (c) Password

3.4. You admit that any information you give to StockBinge during the registration process will always be accurate and updated.

3.5. After registration, you will be a licensed website user and agree to the terms. You will also get access to the services until your subscription period ends.

3.6. You cannot use the services or agree to the terms if: 1. You are too young to legally make an agreement with Stock BInge. 2. The laws of Australia or another country, including the country where you live or use the services, do not allow you to receive the services.

5 Your duty as a member

5.1. As a member, you agree to follow:

5.2. You agree that you will only use the services for things that are allowed by: (a) The Terms and any applicable law or generally accepted guidelines in the relevant jurisdictions

5.3. You are accountable for keeping your email address or password safe. Someone else using your password could lead to the services being shut down right away.

5.4. No one else can use your registration information. You undertake to notify StockBinge immediately of any security breach or unauthorized password or email use.

5.5. Your access to and use of the website is limited, cannot be given to anyone else, and is only for the purposes of StockBinge providing the services;

5.6. You agree that you will only use the website or services for business purposes that have been specifically supported or approved by Stock Binges management.

5.7. You cannot use the website or services for any illegal purpose, such as getting members email IDs by electronic means or other means to send them spam emails or link to the website without permission.

5.8. In addition, you agree that affiliate links, commercials, advertisements and other forms of marketing can be removed from the website anytime and for any reason. This could lead to the end of the services

6. Payment

6.1. If given the choice, you can pay the subscription fee in the following ways: (a) Electronic funds transfer ('EFT') into our nominated bank account (b) Payment by Credit Card (c) PayPal ('PayPal') (d) Cheque ('Cheque')

6.2. You use either Westpac Bank or PayPal to make all of your payments for the services. You promise that you have read, understood, and agreed to be bound by the Westpac Bank/PayPal terms and conditions that can be found on their website before you use the website, the services, or make any payments related to your use of the services.

6.3. You agree that if your bank returns or denies a payment request for the Subscription Fee for any reason, or if you don't pay for some other reason, you will be responsible for all costs related to the Subscription Fee, such as any banking fees and charges.

6.4. You agree that StockBinge can change the subscription fee at any time and that the new subscription fee will take effect after the current subscription period ends.

7 Refund Policy

7.1. You have to pay for each subscription in full before the time starts.

7.2. If you decide to cancel your subscription during the subscription period (after the 14-day money-back guarantee), you cannot get your deposit back.

7.3. We will end your subscription if you don't pay for the full period ahead of time or if you tell us in writing within 14 days of starting your subscription that you want to cancel.

7.4. The money-back promise only applies to people who sign up for StockBinge reports for the first time and request them within 14 days. People who have already subscribed or who have used this money-back promise cannot use it.

7.5. Send the cancellation confirmation note in the mail within 14 days of making the contract. Refunds for subscriptions are not possible after 14 days from the date of payment. Cancelations must be sent via email at @info@stockbinge.com.au or in writing to Stockbinge Pty Ltd at Level 26, 360 Collins Street, Melbourne VIC 3000

8. Staff Trading Policy

8.1. This is our best effort to avoid subscriber conflicts. We restrict staff trading and require holding disclosure. Trading restrictions:

8.2. Staff trades must be approved by one of StockBinge's responsible managers or compliance manager at their discretion.

8.3. Any staff member who receives a referral cannot trade for 24 hours.

8.4. Staff must not trade against buy-sell recommendations. There are rare exceptions to trading against a buy or sell suggestion.

8.5. One month is required for staff to hold all stocks. In rare cases, we may approve sales within a month. Every weekday, from 9am to 5pm (Melbourne time), our personnel are available. Please note that our representatives and account managers who discuss stocks and stock markets over the phone base their comments on our website reports and newsletters. Our Representatives/Account Managers do not consider your financial requirements or investing goals, and no subscriber or third party is guaranteed gains or losses. If information or advice changes, our representatives or account managers are not obliged to notify you.

9. Our liability to you

9.1. StockBinge (ABN : 54 672 177 347), its directors, employees, or agents do not guarantee or make any representations about the accuracy, completeness, suitability, or reliability of the information provided on or through this site. StockBinge (ABN 54 672 177 347), its directors, employees, and agents are not liable for any loss or damage (including indirect, special, or consequential loss or damage) caused by using or relying on website information, even if it is provided without fault.

9.2. StockBinge's responsibility is limited to the cost of re-supplying information on the websites, as long as the law allows it.

9.3. People who use this site shouldn't just rely on the information it gives them because it doesn't take into account their specific financial wants or investment goals. If you want to follow any of our suggestions, you should definitely talk to your planner or concealer first.

10. Copyright and intellectual property

10.1. StockBinge's website, services, and all of their goods that go with them are covered by copyright. Copyright rules in Australia and international agreements protect the information on the website. If it's not stated otherwise, StockBinge or its contributors own or control all rights (including copyright) in the services and the website as a whole. This includes audio clips, text, logos, button icons, graphics, and video images. StockBinge owns all service marks, trademarks, and trade names, which are registered or licensed by them. As a member, StockBinge gives you a worldwide, royalty-free, non-exclusive, and revocable license to:

  1. Use the website as stated in the Terms;
  2. Save the webpage and its content to your device's cache.
  3. You may print website pages for personal, non-commercial use.

10.3. When it comes to the website or the services, StockBinge doesn't give you any other rights. StockBinge has reserved all other rights in a clear way.

10.4. StockBinge owns the website and services included. They own all rights, titles, and interests. Nothing you do on the website sends:

  1. Name, domain name, trading name, trademark, patent, registered design, industrial design, or copyright
  2. Your patent, registered design, or copyrighted item, system, or process.

10.5. You may not broadcast, distribute, upload to a third party, republish, post, transmit, show or play in public, adapt or change the Services or third-party Services without StockBinge's written permission and the appropriate rights owners' permission. This restriction does not apply to public domain or free-to-use website content

11. Privacy

11.1. StockBinge cares about your privacy. If you use the website and/or services, any information you give us is subject to StockBinge’s privacy policy, which you can find on the website.

12. The termination of the contract

13.1. The terms will stay in effect until they are ended by you or StockBinge in the ways described below.

13.2 If you want to end the terms, you can do any of the following: (a) Not renewing the subscription before the end of the subscription period; (b) Giving StockBinge 14 days' notice that you want to end; and (c) Winding up your StockBinge and other service accounts if StockBinge allows it. (d) Send your warning to StockBinge in writing through the "Contact Us" link on our home page.

13.3. StockBinge can end the terms with you at any time if: (a) You don't renew the subscription when the subscription period ends; (b) You have broken any part of the Terms or plan to break any part of the Terms; (c) StockBinge is required by law to do so; or (d) StockBinge thinks it can't make money by providing the services to you anymore.

13.4. StockBinge can end or cancel your membership at any time, as long as it doesn't break any laws in your country. They can also suspend or deny your access to all or part of the Website or the Services without notice if you break any of the Terms or any laws in your country, or if your behavior hurts StockBinge’s name or reputation or violates someone else's rights.

14. Indemnity

14.1. You indemnify StockBinge, its affiliates, employees, agents, contributors, third-party content providers, and licensors for:

(a) Any actions, suits, claims, demands, liabilities, costs, expenses, loss, and damage arising from your content;
